Mighty Goals — Terms of Use

We may update these Terms from time to time. If we make material changes, we will notify you in the App and update the "Effective" date at the top of this page at least 7 days before the change takes effect. If you continue using the App after the changes are effective, you accept the updated Terms. If you do not agree, you must stop using the App and cancel any active Subscription.

3. Eligibility

You may use Mighty Goals only if you can form a binding contract under the law that applies to you. Mighty Goals is intended for users aged 13 and older. In jurisdictions that require a minimum age of 16 for consent to data processing, you must be 16 or older. If you are under the age of majority where you live, you represent that your legal guardian has reviewed and agreed to these Terms on your behalf.

4. Your Account

Mighty Goals creates an anonymous Account by default. You may optionally add an email address or sign in with Apple to enable cross-device sync and recovery. You are responsible for any activity in your Account. If you suspect unauthorised use, email us at [email protected].

5. License and acceptable use

Subject to these Terms, Dual Storm grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on iOS devices you own or control, for your own non-commercial use.

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the App, except where the law allows it
• Bypass, disable, or interfere with security or rate-limiting features
• Use the App or the AI Coaches in a way that is unlawful, harmful, defamatory, or designed to harass another person
• Use the App to generate content that violates the rights of third parties or applicable law
• Use any automated system to access the App in a way that exceeds normal human use
• Resell, sublicense, or commercially exploit the App or its output without our written permission

6. AI coaching — important limitations

We do not guarantee any particular outcome from using the App. The goal-setting and coaching tools in the App are self-reflective aids, not a clinical intervention.

7. User Content

You retain ownership of your User Content. By submitting User Content to the App, you grant Dual Storm a worldwide, non-exclusive, royalty-free licence to host, store, transmit, process, and display that User Content solely as required to operate the Services for you and to improve the App in aggregated, de-identified form.

You agree that your User Content:

• Will not violate the law or third-party rights
• Will not contain malicious code
• Will not contain content that is unlawful, abusive, threatening, or designed to harass another person

You can delete most of your User Content directly from the in-app Settings screen, or by emailing [email protected]. See the Privacy Policy for retention details.

8. Subscriptions and payments

Setup, your first goals, and a limited starter tier of daily check-ins and coaching are free. Full coaching is available via a paid auto-renewing Subscription processed through the Apple App Store using RevenueCat as our subscription management provider. Apple is the merchant of record.

How auto-renewal works

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your Subscription automatically renews at the end of each billing period for the same period and at the same price unless you cancel at least 24 hours before the end of the current period.
• The renewal charge is taken from your Apple ID account within 24 hours prior to the end of the current period.
• Any unused portion of a free trial period, if offered, is forfeited when you purchase a paid Subscription before the trial ends.
• Deleting the app does not cancel an active Subscription. You must cancel through Apple as described below.

Managing or cancelling

You can manage or cancel your Subscription at any time in iOS Settings → [your Apple ID name] → Subscriptions. Cancellation takes effect at the end of the current billing period; you keep access until then.

Refunds

Apple handles refunds for App Store purchases. Refund requests must be made through Apple at reportaproblem.apple.com. If you reside in the European Union, you have the right to cancel a digital purchase within 14 days of purchase under the Consumer Rights Directive, except where you have already started consuming the digital service (which you do once you use the paid coaching tier after the free trial ends).

Price changes

We may change Subscription prices. Where required by Apple or by applicable law, we will give you advance notice and the opportunity to cancel before the new price applies to you.

9. Intellectual property

Mighty Goals, the App, the Mighty Goals brand, the AI Coaches, the Boxy mascot, and all related trademarks, designs, software, and content are owned by Dual Storm Studio Ltd or its licensors and are protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the App or any of its content except the limited licence in Section 5.

10. Service changes and termination

We may change, suspend, or discontinue the App or any feature at any time. We may suspend or terminate your access if you breach these Terms or use the App in a way that risks harm to other users, third parties, or our systems. You can stop using the App at any time and request deletion of your Account.

If we permanently discontinue the App and you have an active Subscription, we will cooperate with Apple to provide a pro-rata refund where required by law.

11. Apple-specific terms

You acknowledge that these Terms are between you and Dual Storm Studio Ltd, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you (where applicable); other than that, Apple has no warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.

12. Warranty disclaimer

This section does not limit any rights you have as a consumer that cannot be excluded under applicable law.

13. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, for death, personal injury, or fraud).

14. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Dual Storm and its affiliates from any claim or demand arising out of your breach of these Terms, your User Content, or your unlawful use of the App.

15. Governing law and venue

These Terms are governed by the law of the Republic of Cyprus, without regard to its conflict-of-laws rules. The courts of Cyprus have exclusive jurisdiction to resolve any dispute, except that consumers may bring claims in the courts of their place of residence where local law gives them that right.

16. Severability

If any part of these Terms is held to be unenforceable, the rest of the Terms will remain in effect. The unenforceable provision will be replaced by an enforceable one that most closely reflects the original intent.

17. Assignment

We may assign or transfer these Terms (in whole or in part) to any affiliate or successor, including in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without our prior written consent.

18. Entire agreement

These Terms, together with the Mighty Goals Privacy Policy, constitute the entire agreement between you and Dual Storm regarding the App and supersede any prior agreements on the same subject matter.
